Case: Court awards fired trucker >$500,000

A truck company must pay a former worker more than $500,000 after Ontario’s Court of Appeal confirms that independent contractors are entitled to the balance of their fixed-term contracts.

Following the contractor’s firing just 7 months into a 72-month contract, a trial judge awarded him the balance he would have been paid for the remainder of the 72 month fixed term.

On appeal, the Court of Appeal confirmed this, however they noted that independent contractors must still mitigate their damages, meaning that any earnings they might have from other worked during the balance of the fixed term contract, would reduce their damages.
