New Law Proposed: Transparent Hiring & Vacation Pay

On Nov. 14, 2023, Ontario introduced Bill 149, Working for Workers Four Act, 2023 (Bill 149), for first reading, meaning it is not yet law.

Two important aspects of the proposed legislation include:

Transparent hiring: The bill would require employers to disclose salary ranges in job postings and to inform candidates if artificial intelligence (AI) is used in hiring.

Vacation pay: According to the current Employment Standards Act (ESA), employers are required to give employees their vacation pay all at once before the vacation starts. However, employers and employees can agree on a different way to handle this. Bill 149 aims to change the ESA to clarify that any alternative payment arrangements must be expressly agreed upon in a formal agreement between the employee and the employer.
