Job interviews are stressful enough, but it’s especially uncomfortable when a potential employer asks an inappropriate question.
In Ontario, employers can’t legally ask about your family or martial status, including if you are single, married or your plans for children. This falls under protections provided by the Ontario Human Rights Code, which prohibits discrimination based on marital status, family status, sex, gender and other protected grounds.
Here’s what to do if you’re asked such a question:
1. Politely decline to answer, as it’s unrelated to your qualifications.
2. Note the details: date, time and question asked and send an email to yourself with these details, which will have a date and time stamp on it as opposed to handwritten notes.
3. Consult a lawyer if you suspect discrimination.
