But it’s complicated. Workplace requirements can’t contravene human rights legislation. If most of the workforce is vaccinated and a worker declines to be vaccinated and return to work, it could be considered “abandonment” of employment, said Tatha Swann.

“Those who don’t comply are rendering themselves unemployable.” But she also points out that, in order for employers to require vaccination, vaccines must be readily available.
